These Terms and Conditions govern the use of the website www.socksley.com (the “Website”) and the purchase of products from SOCKSLEY (hereinafter referred to as “SOCKSLEY”, “we”, “us” or “our”), a sportswear manufacturing and online retail company registered in the Netherlands with registered office at Sieradenweg 17, Flevoland 1336SL, Chamber of Commerce number 97195553, VAT number NL005256207B43.

By accessing the Website or placing an order, you (the “Customer” or “you”) agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website or place orders.

Applicability
1. These Terms and Conditions apply to all offers, orders, agreements and deliveries of products via the Website. Deviations are only valid if agreed in writing.
2. Dutch law applies exclusively to all agreements. For consumers in the EU, mandatory consumer protection rules of your country of residence may also apply.

Offers and Orders
1. All offers on the Website are non-binding and subject to availability.
2. Images, specifications and prices may contain errors; we are not bound by obvious mistakes.
3. An order is placed by completing the checkout process. You will receive an order confirmation by email, forming the agreement.
4. We reserve the right to refuse or cancel orders (e.g., due to stock issues or suspected fraud), with refund if payment was made.

Prices and Payment
1. Prices are in Euros (€), excluding shipping costs (shown separately).
2. Payment methods: iDEAL, credit card, or others as specified by us.
3. Payment must be completed before any product is delivered to you.
4. We use secure payment processing; we do not store full payment details.

Delivery
1. Delivery times are estimates; we aim to deliver within 2-5 business days in the EU.
2. Shipping costs and options are shown at checkout.
3. Risk of loss passes to you upon delivery.
4. We ship primarily within the EU; international shipping may incur customs duties (your responsibility).

Right of Withdrawal (Cooling-Off Period)
As an EU consumer purchasing at a distance, you have the right to withdraw from the contract without giving any reason within 14 days.
1. The withdrawal period starts on the day you (or a designated third party) receive the goods.
2. For multiple items in one order delivered separately, it starts on receipt of the last item.

To exercise the right of withdrawal:
1. Notify us within 14 days via email to hello@socksley.com or using a model withdrawal form where provided.
2. Return the goods without undue delay and within 14 days of notification.
3. You bear the direct cost of returning the goods, unless we agree otherwise.
4. Goods must be returned unused, in original condition with tags and packaging (considering hygiene for sportswear).
5. Exceptions: No right of withdrawal for custom-made items, sealed goods unsealed for health/hygiene reasons (e.g., underwear if seal broken), or items that deteriorate quickly.

We will refund all payments (including standard delivery costs) within 14 days of receiving your withdrawal notice or returned goods (whichever earlier), using the same payment method. We may withhold refund until goods are returned or proof provided.

Warranty and Conformity
1. Goods come with a legal guarantee of conformity: they must match the description, be fit for purpose, and free from defects.
2. Minimum 2 years from delivery for consumers in the EU.
3. Report defects promptly; we will repair, replace, or refund as appropriate.
4. This does not affect your statutory rights.

Liability
1. We are liable for intent or gross negligence.
2. Liability for indirect damages (e.g., lost profits) is excluded.
3. Total liability limited to the order value.

Intellectual Property
All content on the Website (images, texts, designs) is owned by SOCKSLEY or licensed. Unauthorised use is prohibited.

Privacy and Data Protection (GDPR Compliance)
We process your personal data in strict compliance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and applicable Dutch law.
1. Controller: SOCKSLEY is the data controller responsible for processing your personal data.
2. Purposes and Legal Bases: We collect and process personal data (e.g., name, address, email, payment details, IP address) for purposes such as fulfilling orders (legal basis: contract performance), sending order confirmations and newsletters (with your consent), complying with legal obligations (e.g., tax records), and legitimate interests (e.g., fraud prevention, website improvement).
3. Data Minimisation: We only collect data necessary for the specified purposes.
4. Your Rights: Under GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, data portability, and withdraw consent (where applicable). You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or another EU supervisory authority.
5. Data Retention: We retain personal data only as long as necessary (e.g., order data for 7 years due to tax obligations; account data until deletion requested).
6. Security: We implement appropriate technical and organisational measures to protect your data (e.g., encryption, secure servers).
7. Data Transfers: If data is transferred outside the EEA, we use adequate safeguards such as Standard Contractual Clauses.
